Abstract

The initiation of Globalization 2.0 has made global governance increasingly important in addressing the endless emergence of non-traditional security challenges. Global governance at the legal level is mainly divided into hard law and soft law approaches. With the United Nations International Law Commission formally proposing the concept of “non-legally binding international agreements” in 2024, these agreements, as an emerging governance tool, are gradually playing an important role in global governance. This article, focusing on environmental and climate protection agreements, explores the positioning and nature of non-legally binding international agreements, analyzes their complementary role between hard law and soft law approaches, and reveals their unique value in global governance through empirical research. This article aims to provide theoretical basis and practical guidance for the improvement of future international environmental governance systems, promoting the development of global governance models from single paths to diversified paths, and facilitating international cooperation and the achievement of global sustainable development goals.
