Abstract

The growth of digital technology and the internet, which have an impact on innovation in a number of industries, including intellectual property digital painting illustration art, are hallmarks of globalization. Although the internet has many advantages, it also presents a risk of infringement on intellectual property rights due to copying, manipulation, and digital painting, which makes it difficult to discern modified art from genuine works. In situations where the creator’s rights are violated, this study attempts to look into and evaluate the implications of protecting the economic rights of digital painting creations, as well as the actions that digital painting creators may take in the event that their works are appropriated and used by third parties without their consent. Empirical data is used to support normative legal research methods, and study sites are in Jakarta and Palembang. Types of data sources, including secondary and primary data. Field research and literature reviews are used in data collection and processing methods. Data analysis with methods from descriptive analysis. The study’s findings demonstrate how crucial it is to safeguard the financial rights of works of digital art in order to foster innovation in the field, prevent unhealthy competition, and have positive effects on the prosperity and well-being of those who produce these works as well as to give them a feeling of safety and legal assurance. If someone steals and uses a digital painting without permission, the creator will take legal action in two (two) ways: through repressive and preventive measures.
