- Abstract
The practice of a democratic system and state power as the rule of law is the issue examined in this study. In order to apply Indonesian government policy, this study analyzes state power using the 1945 Constitution model, democracy theory, and empirical verification through qualitative research. This study demonstrates how the current political system’s institutional roles, legal standing, and democratic implementation are all out of compliance with the Constitution. The application of law, the implementation of democracy, and the role of state institutions in the country, state, and society are the three main indicators that this study is focused on. Based on the findings of preliminary observations, this was selected because of the symptoms that emerged in the three indicators, which are as follows: 1) The government has not yet fully implemented Pancasila law as a means of upholding Indonesian society’s sense of justice; 2) In terms of indicators for the implementation of democracy, it has not yet been fully implemented in the life of the nation, state, and society; and 3) In indicators of institutional function so far it seems that society and state institutions do not position it as a relationship of sovereign representation of the people.
