Abstract

The paper critically explores the impact of artificial intelligence on legal systems today, and specifically, through algorithmically-assisted legal representation, where the process of analysing the facts of a case, every document related to a case, and determining decisions about that case has all been automated by various types of AI. In many instances, the technologies that are being developed by AI-related laboratories are having an impact on the way lawyers practice and on the types of cases they can handle. Data from both academic studies conducted throughout the world and empirical studies focusing on the impact of these technologies on the way that attorneys represent clients have been used. The technologies being created by AI research laboratories are providing lawyers with significant benefits: increased speed, greater consistency, easier access to information, and reduced costs. However, there are several substantial challenges, including: algorithms that are biased against a specific group of individuals, inconsistent analytical logic, discrimination against individuals due to the reliance upon data in making decisions, and creating difficulties in ensuring the fairness of procedural protections.

A comprehensive five-axis evaluation model— accuracy, explainability, safeguards against bias and fairness, congruence with established procedures, and accountability) designed to address these various issues using currently established global governance structures. This framework will help ensure that the development, implementation, and evaluation of legal AI systems are conducted ethically. Additionally, the paper provides recommendations to law firms, regulatory authorities, judges, and technology developers to assist in integrating AI systems into their operations while promoting the core values of due process, openness to public scrutiny, and equitable access to justice, thereby connecting the potential of technology to the application of normative principles.
