- Abstract
The development of digital technology has given rise to a new phenomenon in the form of child influencers—children who have become public figures and sources of income through social media platforms. In Indonesia, this trend is increasingly prevalent, with parents actively involved in exposing their children’s private lives for commercial purposes. While it brings economic benefits, this practice raises serious concerns regarding child rights violations, economic exploitation, and threats to children’s privacy and mental health. Unfortunately, Indonesia does not yet have a legal framework that explicitly regulates the activities of child influencers, including regarding age limits, broadcast hours, personal data protection, and the management of children’s income. This article aims to analyze this regulatory gap in the national legal system and urge the urgent development of comprehensive legal instruments that support the best interests of children. The method used is a normative juridical approach, analyzing relevant laws and regulations and comparing them with countries that have specifically regulated this phenomenon, such as France and the United States. The results of the study indicate that the development of specific regulations regarding child influencers is an urgent need to ensure child protection in the digital era and to prevent covert exploitation by parents or third parties. The recommendations in this article include the development of child rights-based policies, the protection of children’s data, and state oversight mechanisms for digital commercial activities involving minors.
