- Abstract
The advancement of telemedicine in Indonesia has significantly improved access to healthcare services; however, it has also heightened the potential for misuse of patients’ sensitive medical information. This study aims to examine the legal framework governing the protection and confidentiality of medical data in telemedicine practices, to identify possible forms of data misuse, and to assess how criminal liability is applied under the legislation on Personal Data Protection (PDP Law). The discussion further explores its connection with existing healthcare regulations and the possible accountability of corporations operating telemedicine platforms. The findings indicate that the PDP Law establishes material offenses with penalties of imprisonment and/or fines for the unauthorized collection, disclosure, or utilization of personal information, including health-related data. Nevertheless, the degree of enforcement effectiveness remains contingent upon the preparedness of regulatory bodies, the data security management of telemedicine providers, and the ethical as well as professional adherence of medical personnel.
