- Abstract
Indonesia recognizes only two genders, namely male and female, and does not recognize a third gender. This research aimed to discusses and analyzes the legality of gender reassignment on Identity Cards under Indonesian law, given this binary recognition, and further examines the legal position and status of transgender individuals after such a change. This study is normative legal research that employs a statutory approach. The findings of this research indicate that provisions regarding gender changes on identity cards are measured in Article 3 of Law No. 23 year 2006 concerning Population Administration in conjunction with Article 56, paragraph (1) of Law No. 23 year 2006 concerning Population Administration, and Article 97, paragraph (3) of Presidential Regulation No. 25 year 2008 on the Requirements and Procedures for Population Registration and Civil Registration. The legal status of transgender individuals who have changed their gender on their identity card is recognized as either male or female, based on the court’s determination.
