Contribution Legal Protection for Health Human Resources in the Use of Telemedicine Applications by Non-Health Facility Providers

Abstract

Technological developments provide opportunities for medical personnel and health workers to provide health services to patients through a digital platform with an application. The provision of telemedicine using applications has increased since the COVID-19 pandemic. The practice of health services carried out by Health Human Resources (medical personnel and health workers) has the risk of legal problems. This study aims to determine the legal protection regulations for doctors and health workers who practice using a digital telemedicine platform with non-health facility providers. We used a non-random sampling technique for 6 medical personnel and 6 health workers and an accidental sampling technique for 6 patients. The resource persons consist of the Semarang City Health Office, the Semarang City Communication and Informatics Office, the Management of the All-Indonesia Hospital Association of Central Java, and the Indonesian Doctors Association of Semarang City. Legality is a basic thing that must be fulfilled by every Health Human Resources who provides services to patients. Legality with ownership of a Registration Certificate (STR) and Practice License (SIP). Medical personnel and health workers who practice using telemedicine applications do not have a SIP. Legal protection is preventive, namely the right to legal immunity, where medical personnel and health workers who were suspected of making mistakes in their practice may not be immediately resolved through the courts but resolved through alternative dispute resolution outside the courts or through restorative justice mechanisms.
