- Abstract
With the development of technology, internet has brought about lots of convenience but concurrently many security risks. Telecommunication network fraud broke out frequently and increased rapidly with the tendency of organization and chain. Therefore, traditional theory of accomplice has faced the crisis of adaption to the fragmentation of the division of labor and the concealment of conduct. In judicial practice, there also exists the situation of “Same case, the different verdict”. This thesis will explore the path of cognizance of telecommunication network fraud accomplice from the perspective of “Degree of contribution of behavior” and “Degree of subjective knowledge”, using literature research and case study method. As for subjective knowledge, it is proposed to establish a three-level cognizance standard of “Clear cognition-high probability-should know but not know”. According to the contribution of behavior, a three-level evaluation model of“core layer-tool layer-base layer” is constructed. Aimed at offering a more accurate and scientific referee basis for judicial practice.
