Abstract

Aviation is generally regarded as a secure means of transportation; however, the risk of aircraft accidents remains a significant concern. To guarantee equitable compensation for those affected by such incidents, robust regulations must be implemented. Each aircraft mishap serves as a reflection of a nation’s adherence to aviation safety standards, which are assessed through comprehensive safety audits. According to the 2020 ICAO Safety Report, there has been a noticeable rise in fatal aviation accidents globally. This underscores the urgent need for stringent regulations surrounding compensation, ensuring that both aviation industry stakeholders and service consumers have clear legal protections. This study adopts a descriptive and normative qualitative framework, utilizing both primary and secondary data analyzed qualitatively through a deductive lens. The findings indicate that establishing strict regulations is essential for guaranteeing just compensation for victims of aviation accidents. Additionally, insurance companies play a crucial role in managing the risks associated with aircraft incidents, facilitating fair compensation aligned with relevant legal requirements, which necessitates close collaboration among various parties within the aviation sector.
