Abstract

With the development of data and information technology, the online and data-based office of enterprises has experienced unprecedented development. As a result, the boundaries between the office environment and the personal living environment have become increasingly blurred, and the supervision and control of enterprises have led to a high and frequent risk of damage to workers’ personal information, making the protection of workers’ personal information an important issue involving a variety of systems and mechanisms, such as civil law, personal information protection law, and labour law. At present, the protection of workers’ personal information in the context of corporate employment is plagued by problems such as the failure of the “informed consent rule”, the impact of new technologies, and the frequent occurrence of disputes. The article summarizes the relevant legal systems, points out the inadequacies of the legal provisions, and proposes to strengthen the protection provisions, strengthen the enforcement of labour inspection, introduce the judicial review criteria of necessity and proportionality, and promote the self-discipline of enterprises to comply with the law, in order to build a perfect system for the protection of workers’ personal information, balance the rights of workers and employers, and safeguard the security of workers’ information and their human dignity.
