- Abstract
The recovery of lost overseas cultural relics is a crucial issue for safeguarding cultural heritage and upholding national sovereignty and cultural dignity. However, legal recovery efforts face numerous obstacles, including disputes over ownership, identification issues in private international law, differing national standards for jurisdiction and legal standing, and disagreements over the enforceability of domestic and international conventions. In practice, China has continuously innovated, pioneering new pathways for reclaiming lost cultural heritage. The road to recovery is far from smooth, and to improve efficiency, China must establish a multi-tiered mechanism that combines domestic legal theory, legislative and judicial practices, and international cooperation to facilitate the return of lost relics and protect the roots of national culture.
