- Abstract
The deep involvement of artificial intelligence (AI) technology in the entire process of clinical research, from data mining to academic paper generation, has triggered dilemmas in copyright protection. Existing laws have institutional gaps in terms of subject eligibility, behavioral boundaries, and originality determination. This paper analyzes the practices of foreign countries and regions and explores possible paths for China to construct a copyright protection system for AI-generated content. It is proposed that the copyright subject should be the actual creative participants, the boundaries of medical data use should be clarified, the connotation of acts should be expanded while the extension should be narrowed, the originality requirement should be determined by general standards, and a data filing system should be established. Ultimately, an intellectual property protection system for smart healthcare that balances innovation incentives and public health interests will be formed.
