Abstract

The balance between administrative power and civil rights is a fundamental requirement for building a rule-of-law society and a key factor in maintaining social stability and fairness. In the digital age, this balance faces numerous new challenges and dilemmas, making it an urgent issue to construct effective balancing mechanisms. This paper analyzes the practical dilemmas in balancing administrative power and citizens’ rights in the digital era, pointing out current issues such as the expansion of administrative power, the concealment of algorithmic decision-making, and insufficient protection of citizens’ rights. Subsequently, it proposes the construction of a balancing mechanism for administrative power and citizens’ rights through three dimensions: improving legislative safeguards, enhancing procedural norms, and strengthening the supervision of administrative power. The aim is to protect the various rights of citizens in the digital age, promote lawful administration by the government, achieve a dynamic balance between administrative power and citizens’ rights in the digital era, and advance the construction of a digital rule-of-law government and social fairness and justice.
